User Agreement

In order to better provide services to you, please read and fully understand the following ‘Yachttrading User Agreement’ (hereinafter referred to as the ‘Agreement’), fully understand the contents of the terms and conditions, especially the authorisation, exemption or limitation of liability, the application of the law and dispute resolution provisions and other terms and conditions highlighted in bold underline. and choose to accept or not accept. The terms of authorisation, exemption or limitation of liability may be highlighted in bold. If you are under 18 years of age, please read and fully understand this Agreement with your legal guardian and obtain the consent of your legal guardian before downloading/using Yachttrading related software or services provided by Yachttrading.

 

If you disagree with any of the terms and conditions of this Agreement, you may choose not to download, install, register, log in to, or use (collectively, the ‘Use’) any of the software or services provided to you by Yachttrading. Regardless of how you use any software services provided by Yachttrading, you are deemed to have fully understood this agreement and commitment as a party to this agreement to fully accept all the terms of this agreement.

 

I. Scope of Application of this Agreement

 

1.1 This Agreement is an agreement between you and Guangzhou Skywalker Travel Service Consulting Co., Ltd. and the related services provided by the possible existence of the operation of related units (hereinafter referred to as ‘Yachttrading’) on your use of Yachttrading related software or services. The term ‘User’ or ‘You’ refers to the person using the Yachttrading Software and Services.

 

1.2 The ‘Yachttrading-related software or services’ under this Agreement refers to the products, software and services provided by Yachttrading to Users, including but not limited to online media, community interaction, Internet value-added, interactive entertainment, e-commerce and advertising.

 

II. Description of Services:

 

2.1 Yachttrading provides you with including but not limited to the following software or services:

 

- Yachttrading web site (https://www.yachttrading.com/) and any other web site operated by Yachttrading;

 

- Yachttrading directly owns or operates all terminal client products including, but not limited to, PCs, tablets, mobile phones, etc., such as the Yachttrading Sports App;

 

- Yachttrading directly owned or operated servers, network storage space;

 

- Other software, technology or services provided to you by Yachttrading.

 

2.2 You may use Yachttrading's software or services by pre-installing, downloading from Yachttrading, or downloading from a third party authorised by Yachttrading, or by accessing Yachttrading's website. If you are not from the aforementioned way, but through any other way, channel, way to obtain Yachttrading software or services (including but not limited to account, client downloads, etc.) are illegal, Yachttrading does not recognise its validity, once found, Yachttrading has the right to immediately make deletion, zero, blocking, etc., and any consequent adverse consequences shall be borne by you. Yachttrading reserves the right to immediately delete, zero, block the number and other processing, and any resulting adverse consequences shall be borne by you.

 

2.3 Yachttrading may have developed different versions of the application software for different terminals, you should obtain, download and install the appropriate version according to the actual equipment. In order to better enhance the user experience and services, Yachttrading will from time to time provide software updates or changes (including, but not limited to, software modifications, upgrades, functional enhancements, development of new services, software replacement, etc.), Yachttrading will, including but not limited to, the system prompts, announcements, letters and other ways to prompt you to update, download or use, you have the right to choose to accept the updated version or Service, if you do not agree or do not accept the Yachttrading related software or service changes, please directly reject, stop, cancel the use of the act, otherwise regarded as you agree and accept the change, at the same time, the act of agreeing and accepting is still subject to the constraints of this Agreement.

 

This agreement is not expressly authorised by all other rights are still reserved by Yachttrading, you in the exercise of these rights must be separately obtained from Yachttrading's written permission, while Yachttrading, if you do not exercise any of the foregoing rights, and does not constitute a waiver of the right.

 

III. User Registration and Account:

 

3.1 The account you set up shall not violate national laws and regulations and the relevant rules of Yachttrading, shall not commit any act that infringes upon the national interests, damages the legitimate rights and interests of other citizens, and is harmful to social morals and ethics, and there shall be no unlawful and undesirable information in the registration information such as your account name, avatar and other personal information, and you shall not open an account in the name of another person without his/her permission (including but not limited to) Without the permission of others, you shall not open an account in another person's name (including but not limited to fraudulently using another person's or organisation's name, name, font size, avatar and other ways that are sufficiently confusing), and you shall not maliciously register for a Yachttrading account (including but not limited to frequently registering, registering for an account in bulk and other behaviours). In the process of account registration and use, you must comply with the ‘seven bottom lines’ of laws and regulations, the socialist system, national interests, the legitimate rights and interests of citizens, public order, morals and the authenticity of information.

 

3.2 Your registered account in Yachttrading ownership and related rights and interests are owned by Yachttrading, you complete the registration procedures only enjoy the right to use the account. Your account is limited to your own use, without the written consent of Yachttrading, prohibited in any form of gift, borrow, rent, transfer, sell or otherwise licensed to others to use the account. If Yachttrading discovers or has reasonable grounds to believe that the user is not the initial registrant of the account, Yachttrading has the right to suspend or terminate the provision of services to the registered account without notice to you, and has the right to cancellation of the account, without having to bear the legal responsibility to the user who registered the account.

 

3.3 You are responsible for maintaining the security and confidentiality of your personal account and password, and bear full legal responsibility for the activities you engage in the name of your registered account, including but not limited to the modification of data, published statements and other operational behaviour in Yachttrading.

 

3.4 Due to other people's malicious attacks or your own reasons or other irresistible factors that lead to account theft, loss, are your own responsibility, Yachttrading does not assume any responsibility.

 

3.5 In order to fully use the account resources, such as your initial login after registration is not carried out in a timely manner to use or for more than a year in a row without logging in the account to use and other circumstances, Yachttrading has the right to withdraw your account nickname.

 

Protection of personal information of users:

 

4.1 You understand and agree that for security and identification (such as account or password recovery appeal service, etc.) considerations, you may not be able to modify the initial registration information provided during registration and other verification information.

 

4.2 Yachttrading will not transfer or disclose Users' personal information to any non-affiliated third party, except in the following circumstances:

 

4.2.1 Relevant laws and regulations or judicial, administrative and other state organs require;

 

4.2.2 Authorisation is obtained from the user or the guardian of the minor user;

 

4.2.3 Initiating litigation or arbitration against the User in order to safeguard Yachttrading's own legitimate rights and interests;

 

4.2.4 The User discloses his/her personal information to a third party at his/her own discretion.

 

4.2.5 The disclosure of any personal information due to the User's disclosure of his/her user password to another person or sharing of the registered account and password with another person, or any other disclosure of personal information that is not caused by Yachttrading;

 

4.2.6 disclosure to a third party for the purpose of detecting harmful and fraudulent Users, provided that Yachttrading shall enter into an agreement with such third party to ensure that such third party assumes no less responsibility and liability than that set out in this Agreement and Yachttrading's Privacy Policy;

 

4.3 Please note that you should not disclose any important information or material information that you consider to be sensitive, such as your various property accounts/accounts, bank cards, credit cards, third-party payment accounts and corresponding passwords, etc., in the use of Yachttrading and related services, or you shall be solely responsible for any damages arising therefrom.

 

4.4 You may also read Yachttrading's Privacy Policy to learn more about how Yachttrading collects, uses, stores and protects your personal information and what rights you have.

 

V. Code of Conduct for Users

 

5.1 Unless permitted by law or with the prior written permission of Yachttrading, your use of Yachttrading related software or services shall not have the following behaviour:

 

5.1.1 Use without the authorisation or permission of Yachttrading any software, plug-ins, plug-ins, systems or third-party tools to Yachttrading related software or services for the normal operation of the interference, destruction, modification or exert other influence.

 

5.1.2 using or targeting Yachttrading related software or services to carry out any act that endangers the security of the computer network.

 

5.1.3 attempting to interfere with or disrupt the normal operation of the system or website of Yachttrading-related software or services, intentionally spreading malicious programs or viruses and other acts of destruction and interference with normal network information services;

 

5.1.4 Illegal intrusion into other people's networks, interference with the normal function of other people's networks, theft of network data and other activities that endanger network security;

 

5.1.5 Reverse engineering, reverse compilation, compiling or otherwise attempting to discover the source code of the Software in relation to Yachttrading.

 

5.1.6 Maliciously registering and using Yachttrading accounts, including but not limited to frequent and batch registration of accounts, creation of false accounts, and intentional impersonation of others.

 

5.1.7 Forcing or inducing other users to follow or click on linked pages or share information;

 

5.1.8 Using Yachttrading's account or services under this Agreement to engage in any illegal or criminal activities;

 

5.2 Minors under the age of 18 who use Yachttrading-related software or services should obtain the consent of their guardians and use them under the guardian's supervision and guidance. If any underage user violates laws and regulations or the contents of this agreement when using Yachttrading related software or services, the user and his/her guardian shall bear all the consequences arising therefrom in accordance with the law.

 

5.3 Yachttrading has the right to review and supervise the user's use of Yachttrading's relevant software or services. If Yachttrading has reason to believe that the user violates any of the above provisions when using Yachttrading's relevant software or services, Yachttrading, or any person or organisation authorised by Yachttrading, has the right to make independent judgement and take technical measures at any time. Yachttrading or its authorised person or agency at any time have the right to make independent judgments and take technical means to be deleted, blocked, broken links, without any notice, at the same time, Yachttrading has the right to depending on the nature of the user's behaviour, including but not limited to the suspension or termination of the service, restriction, freezing or termination of the use of the Yachttrading account, to pursue the relevant legal responsibility and other measures.

 

Sixth, the use of information content norms

 

6.1 Without the written permission of Yachttrading, you may not by yourself or authorised, permitted, assisted any third party to this agreement Yachttrading software and related services in the information content of the following acts:

 

(1) Copy, read, adopt the information content of the Yachttrading Software and related services for commercial purposes including, but not limited to, publicity, increasing the number of readers and viewers;

 

(2) Unauthorised editing, collating or arranging of the information content of the Yachttrading Software and related services and then displaying it in channels other than the source page of the Yachttrading Software and related services;

 

(3) Adopting any form of identification methods, including but not limited to special logos, special codes, etc., to generate traffic, readership guidance, transfer, hijacking, and other adverse effects on the information content of the Yachttrading Software and related services on its own or by assisting a third party to do so;

 

(4) Other illegal access to or use of the information content of the Yachttrading Software and related services.

 

6.2 With the written permission of Yachttrading, your sharing, forwarding and other behaviours of the information content of Yachttrading Software and related services shall also comply with the following norms:

 

(1) You shall not make any changes to the source pages of the Yachttrading Software and related services in any form, including but not limited to links to the homepage (profile page) of the Yachttrading Software and related services, links to the advertisement system and other entrances, and you shall not make any changes to the display of the source pages of the Yachttrading Software and related services in any form. blocking, insertion, pop-up windows and other obstructions;

 

(2) Relevant data content shall not be used for purposes outside the scope of Yachttrading's written licence, for any form of sale and commercial use, or disclosed to a third party, provided or allowed to be used by a third party in any way;

 

Intellectual Property Rights

 

7.1 Yachttrading related software or services contained in the logo, layout, typography, text, pictures, graphics, audio, video, ideas, patterns, etc. are subject to copyright, trademark rights and other legal protections, without the written consent of the relevant rights holders (including Yachttrading and other original rights holders), the above content are not allowed to be in any platform directly or indirectly Without the written consent of the relevant rights holders (including Yachttrading and other original rights holders), none of the above contents may be directly or indirectly published, rewritten or redistributed in any platform for the purpose of publication or use, or used for any other commercial purposes.

 

7.2 For the contents posted or uploaded on Yachttrading, you shall guarantee that you are the copyright owner or have obtained the legal authorisation from the copyright owner or other right holders who have legal rights over the said contents, and that the contents will not infringe the legal rights and interests of any third party. If a third party raises objection about copyright or other legal rights and interests, Yachttrading has the right to delete the relevant content according to the actual situation, and has the right to pursue your legal responsibility. If you cause any loss to Yachttrading or any third party, you shall be responsible for full compensation.

 

7.3 Yachttrading related software or service development or operation of all data and information generated during the process to enjoy all rights.

 

VIII. Advertising

 

8.1 If you do not agree with any of the advertisements, you have the right to choose to click on the ‘X’ in the lower left corner of the advertisement to close the advertisement or stop using the Yachttrading related software or services. You can unsubscribe from marketing messages (if any) that we send you. For more information, please refer to the Privacy Policy.

 

IX. Legal Liability

 

9.1 If Yachttrading discovers or receives a report or complaint from others that a user has violated this agreement, Yachttrading has the right to review the relevant content at any time without notice and, depending on the severity of the case, impose penalties on the offending account including but not limited to warnings, account blocking, equipment blocking, function blocking, deletion or blocking of published information, and cessation of the provision of services.

 

9.2 Users who are banned for violating the User Agreement will not be automatically unblocked. Yachttrading may submit a complaint to Yachttrading, which will review the complaint and decide whether or not to change the penalties by its own reasonable judgement.

 

9.3 Yachttrading has the right to impose penalties in accordance with reasonable judgement on the violation of relevant laws and regulations or the provisions of this Agreement, to take appropriate legal action against any user who violates the law, and to save the relevant information in accordance with laws and regulations and report it to the relevant authorities, etc., and the user shall bear all the legal liabilities arising therefrom.

 

9.4 As a result of the user's violation of this agreement, caused by or arising from any third party claims any claims, demands or losses, including reasonable attorneys' fees, the user shall indemnify and hold harmless Yachttrading and cooperating companies, affiliates.

 

X. Disclaimer

 

10.1 Yachttrading does not warrant that Yachttrading related software or services will: fully meet the User's requirements or expectations for use; be timely, secure, reliable, or error-free; or that any errors will be corrected.

 

10.2 Yachttrading reserves the right to modify, update, interrupt or terminate the Yachttrading related software or services after prior notice without being responsible or liable to the User.

 

10.3 The contents posted, uploaded, disseminated or reproduced by the User in the Yachttrading related software or services only indicate his/her personal stance and viewpoints, and do not represent the stance or viewpoints of Yachttrading, and the User shall be responsible for the aforesaid contents by himself/herself. Yachttrading shall not be liable for any disputes arising out of the above content, and the user shall bear all legal and joint liability.

 

10.4 For network service interruption or other defects caused by force majeure or reasons beyond Yachttrading's control (including but not limited to: viruses, Trojan horses, malicious program attacks, network problems, system instability, system or equipment failures, communication failures, power failures, third-party service defects, governmental actions, natural disasters, etc.), Yachttrading does not assume any responsibility. Yachttrading does not bear any responsibility, but will endeavour to minimise the losses and impacts caused to users as a result.

 

10.5 Yachttrading according to this agreement to obtain the right to deal with illegal and unauthorised content, the right does not constitute Yachttrading's obligations or commitments, Yachttrading can not guarantee the timely detection of illegal and unauthorised behaviour or corresponding treatment, Yachttrading will comply with the provisions of relevant laws and regulations.

 

XI. Terms of Use for Minors

 

11.1 If the user is a minor under 18 years of age, should be under the guardian's supervision, guidance and consent of the guardian to carefully read this agreement before using the Yachttrading software and related services, Yachttrading will rely on the personal information provided by the user to determine whether the user is a minor.

 

11.2 Minor users understand that if you violate the laws and regulations and the contents of this Agreement, you and your guardian shall bear all the legal liabilities that may arise as a result in accordance with the law.

 

11.3 Special Notice for Minor Users:

 

11.3.1 Teenagers using the Software and related services should be supervised and guided by their guardians, learn to use the Internet correctly within a reasonable range, avoid becoming addicted to virtual cyberspace, and develop good Internet habits. Youth users must comply with the National Youth Internet Civilisation Convention:

 

(1) Be good at online learning and do not browse undesirable information;

 

(2) Be honest and friendly in communication, and do not insult or defraud others;

 

(3) Enhance the sense of self-protection, do not date online friends at will;

 

(4) To maintain network security, do not disrupt the network order;

 

(5) To be physically and mentally healthy and not to indulge in virtual time and space.

 

11.4 In order to better protect the privacy rights of minors, the company reminds users to be careful about publishing content containing minors‘ material, once published, it is considered that users agree that the software and related services display minors’ information, portrait, voice, etc., and allow the company to use and handle such minors' content in accordance with this agreement.

 

XII. Modification of the Agreement and Others

 

12.1 The establishment, entry into force, performance, interpretation and dispute resolution of this Agreement shall be governed by the laws of the mainland of the People's Republic of China. Yachttrading reserves the right to modify or change the terms of this Agreement in accordance with changes in the fulfilment environment or changes in relevant laws, regulations and normative documents, or due to the needs of business development. Once the content of this agreement changes, Yachttrading will be in the agreement before the effective date of the modified agreement in the Yachttrading software to be published, the publication of the act is deemed to be Yachttrading has notified the user of the revised content. If you do not agree with Yachttrading's modifications to the terms and conditions of this agreement, the user has the right to stop using Yachttrading's software or services. If the user continues to use Yachttrading related software or services, the user is deemed to accept Yachttrading's modifications to the relevant provisions of this Agreement. The other provisions of this Agreement shall remain in full force and effect.

 

12.2 The headings in this Agreement are for convenience and readability only and do not affect the meaning or interpretation of any provision of this Agreement. The copyright in this Agreement is owned by Yachttrading and Yachttrading reserves the right to make all interpretations and modifications.

 

12.3 If any dispute arises in the course of the performance of this Agreement, it should be resolved through friendly negotiation first, and if the negotiation fails, either party may file a lawsuit with the People's Court of Tianhe District, Guangzhou City.
